Civil liability turns on culpability. Under 19 U.S.C. § 1592 a material false statement or omission in an entry is penalized at one of three levels, and the ceiling differs by level: the domestic value of the merchandise for fraud, four times the loss of duties for gross negligence, and two times the loss for negligence, with a different measure where no revenue was lost. The limitations period is five years under § 1621, running from the violation or, for fraud, from its discovery. Disclosure before the government finds it changes the exposure rather than the duty. A valid prior disclosure under § 1592(c)(4), made before CBP has commenced a formal investigation and before the importer knows of it, limits the penalty to interest on the loss of revenue in a revenue-loss case. Tendering the unpaid duties remains required either way.Seizure and criminal referral are separate tracks. Merchandise entered by false statement is subject to forfeiture under § 1595a, with the administrative petition route in 19 CFR Part 171, and a response to a Form 28 or Form 29 is where the factual record is set before any penalty notice issues. Criminal charges proceed under 18 U.S.C. § 542 for entry by false statement or § 545 for smuggling, and privilege in an internal review is preserved by the terms of counsel’s engagement rather than by the review’s subject matter.
