New York does not require that discipline be fair. What it prohibits is retaliation for protected activity, and the question in these cases is whether the stated reason — a sudden negative review, a demotion, a disciplinary notice — was the real one. Labor Law § 740 was substantially broadened effective January 26, 2022. An employee now needs only a reasonable belief that the employer's conduct violates a law, rule or regulation, or poses a substantial and specific danger to public health or safety; proof of an actual violation is no longer required. Coverage extends to former employees and independent contractors, the limitations period is two years, and remedies include reinstatement, back and front pay, a civil penalty of up to $10,000, attorney's fees, and punitive damages for willful conduct. The statute ordinarily expects the employee to notify the employer and allow a chance to correct, with exceptions where there is imminent danger. Health care employees have a separate and broader provision in § 741. The federal deadlines differ sharply and are the reason timing matters more than the merits at the outset: 30 days to OSHA for a § 11(c) safety complaint, 180 days to OSHA under Sarbanes-Oxley § 806, 300 days to the EEOC for Title VII retaliation in New York, six years under Dodd-Frank — which, after Digital Realty Trust v. Somers, protects only those who reported to the SEC itself — and six years for a False Claims Act retaliation claim.
