How Do You Draft an Employment Contract in Washington, D.C.?

Most of what protects an employee in the District is not in the contract, and cannot be written out of it. Statutory rights apply regardless. Paid sick leave, minimum wage, and overtime attach by operation of law. A contract that provides less does not fail — the provision simply does not bind, and the statutory floor governs instead. The exposure is in wage claims, not enforceability. The District's wage payment law allows recovery of up to four times the unpaid amount, plus attorney's fees. It is among the most severe wage remedies in the country, and it reaches classification errors and final-pay timing as readily as deliberate underpayment. Non-competes are restricted by income. Since 2022, non-compete provisions are prohibited outright for employees below a compensation threshold and permitted only within defined limits above it. Employers also owe advance written notice, and restrictions on outside work during employment are themselves limited. A separate written notice is required. Employers must give employees written notice of their terms of employment. That obligation exists independently of whatever the employment agreement says.
