Workers' compensation pays without proof of fault. It also bars you from suing your employer. That trade-off is the system. Benefits cover medical treatment and a portion of lost wages regardless of who caused the accident. What they do not cover is pain and suffering, and Section 11 makes compensation the exclusive remedy against the employer. But the employer is often not the only party. A general contractor, an equipment manufacturer, a property owner, or a driver may be liable in tort — and a third-party action allows the full range of damages that workers' compensation excludes. Construction injuries deserve particular attention. New York Labor Law § 240(1) imposes absolute liability on owners and general contractors for gravity-related injuries, with no comparative negligence defense. Recovery in those cases frequently exceeds what the compensation claim provides by a wide margin. Two deadlines run early. Written notice to the employer within thirty days of the injury, and a claim filed within two years — measured from the accident, or for an occupational disease, from when the worker knew or should have known the condition was work-related. And the compensation carrier has a lien. If a third-party case recovers, the carrier is repaid from it. How that lien is negotiated affects what actually reaches the worker, and it is worth understanding before either case is resolved.
