What the contract does control is the allocation between the parties: what the seller represents, what the disclosure schedules qualify, how long those representations survive — which in New York displaces the statute of limitations — and whether recovery is capped, basketed, and limited to escrow.That machinery works well. It just does not reach the three items above.
