For a foreign drug manufacturer, an inspection finding converts into a product problem. Under § 501(a)(2)(B) of the FDCA, failure to comply with current good manufacturing practice renders the drug adulterated regardless of whether the product itself is defective, and under § 501(j) the same follows if the owner refuses to permit an inspection. Observations are issued on Form FDA 483. A written response within 15 business days is considered before a Warning Letter issues; after that, the matter moves to the next stage. An Official Action Indicated classification also blocks approval of pending applications associated with that facility, so an inspection outcome affects commercial timelines directly, not only compliance status. Import holds operate through a separate mechanism. Under § 801(a) FDA may detain an article without physical examination, and placement on an Import Alert means shipments are detained on arrival. Removal is sought by petition demonstrating that the conditions have been corrected, and FDA ordinarily expects a record of five consecutive compliant entries before granting it — which is why the hold typically outlasts the corrective action itself. Foreign establishments must also designate a United States agent and maintain registration and drug listing. What counsel does in these matters is assess the regulatory characterization of the findings, prepare the 483 response and any Import Alert petition, and manage the sequence between the facility’s remediation and the submissions that depend on it.

The penalty turns on willfulness. For a non-willful violation, 31 U.S.C. § 5321(a)(5) sets a ceiling that the Supreme Court held in Bittner v. United States (2023) applies per annual report, not per unreported account. For a willful violation the ceiling is the greater of the adjusted statutory amount or 50 percent of the account balance at the time of the violation, assessable for each of six open years. FATCA reporting is separate: Form 8938 is filed with the return under 26 U.S.C. § 6038D, and a failure carries its own penalty with continuation amounts after notice. Which disclosure route is available depends on the same question. The Streamlined Filing Compliance Procedures require a non-willfulness certification and are closed once an examination has begun. The IRS Criminal Investigation Voluntary Disclosure Practice, entered by Form 14457 preclearance, covers a six-year period and carries a civil fraud penalty on the highest-deficiency year together with a willful FBAR penalty. Timing controls the outcome more than argument does. Voluntary disclosure is unavailable once the taxpayer is under criminal investigation or the information has already reached the Service, including through an FATCA report from the foreign institution, and a willful failure to file can be charged under 31 U.S.C. § 5322 within the five-year limitations period.

Hiring a cartel leniency application attorney is critical to securing DOJ immunity when internal compliance uncovers antitrust violations. The Department of Justice Antitrust Division grants full criminal immunity only to the first company that reports price-fixing or bid-rigging. A marker application halts the federal clock, protecting the initial applicant from prosecution while an internal investigation proceeds. Failing to act swiftly exposes corporations and executives to severe federal penalties.

Software copyright infringement occurs when someone reproduces, distributes, displays, or creates derivative works based on your copyrighted code or software without authorization, and understanding the scope of your legal exposure requires knowing both the statutory framework and the practical defenses available in litigation. The Digital Millennium Copyright Act and the Copyright Act establish strict liability for unauthorized copying, meaning intent to infringe is not required for a court to find infringement. When infringement is established, the copyright holder may seek statutory damages ranging from actual damages and profits to enhanced penalties, and procedural defects in notice, registration timing, or claim construction can create viable dismissal arguments or narrow recovery exposure. This article covers the elements courts examine when evaluating infringement claims, the defenses that commonly succeed, the role of software copyright registration, and the timing issues that affect your litigation posture.
