Unfair Trade Practices Complaint Representation Attorney Guides Filing

False advertising and trademark claims arise under different subsections of the same statute. Section 43(a)(1)(A) of the Lanham Act, 15 U.S.C. § 1125(a)(1)(A), covers likelihood of confusion as to source; § 43(a)(1)(B) covers false or misleading statements about one’s own or another’s goods. Standing under the latter requires a commercial injury within the statute’s zone of interests and proximate causation, as the Supreme Court held in Lexmark v. Static Control (2014). State law adds a claim but not always a plaintiff. New York General Business Law § 349 requires consumer-oriented conduct, so a purely competitor-against-competitor dispute often fails on that element, while § 350 for false advertising carries the same requirement. Common-law unfair competition remains available where bad faith can be pleaded. The remedy drives the pleading. A preliminary injunction is the usual object, and the presumption of irreparable harm restored by 15 U.S.C. § 1116(a) in 2020 applies to a found or likely violation. A damages award for false advertising generally requires evidence of actual deception or diversion of sales, and an accounting of the defendant’s profits under § 1117(a) is a separate request that must be pleaded as such.

Interlocutory Appeal: What It Is, When to File, and How to Succeed

An interlocutory appeal challenges a trial court ruling before final judgment is entered, but only when strict CPLR criteria and 30-day deadlines are satisfied. Not every adverse ruling qualifies. An interlocutory appeal succeeds only when the order falls within a recognized statutory category: provisional remedies, jurisdictional rulings, or situations where waiting for final judgment would cause irreversible harm. I've seen clients lose winnable positions simply because no one moved on the appeal in time. This guide explains what interlocutory appeal means, when courts grant it, and what you must do the moment a qualifying order comes down.

Understanding how tax credits work, which tax credits apply to your circumstances, and what documentation the IRS requires can significantly affect your final tax outcome. Whether claiming credits for children, education expenses, childcare costs, retirement savings, or energy-efficient home improvements, taxpayers must satisfy eligibility rules and maintain adequate records. Proper planning, accurate reporting, and thorough documentation help maximize available tax credits while reducing the risk of IRS adjustments, penalties, or audit disputes.

How Do Domestic Violence Statistics Affect Alimony Amounts in New York?

Domestic violence history can influence alimony calculations in New York, though statistics alone do not determine the award. New York courts consider a broad range of factors when setting spousal support, and evidence of domestic violence may affect both the amount and duration of an award. The connection between violence and alimony is not automatic; rather, courts weigh abuse as part of the overall equitable distribution analysis. Understanding how this factor operates within the statutory framework helps clarify what role documented history plays in support negotiations and litigation.
