Global Monopoly Investigation Defense: Frand Patent Licensing Strategy

Antitrust exposure from patent licensing is narrower than it is often described. Unilateral refusal to license is generally lawful, and the Ninth Circuit held in FTC v. Qualcomm that the licensing practices challenged there did not violate Section 2. On standard-essential patents, the federal posture has shifted. The 2019 policy statement was withdrawn in 2022 in favor of case-by-case assessment, and the Antitrust Division has since filed statements of interest opposing antitrust claims premised on SEP abuse — taking the position that inclusion in a standard does not establish market power, and that breach of a RAND commitment is not by itself exclusionary conduct. Under Broadcom v. Qualcomm, a claim requires an intentionally false commitment that harmed the standard-setting process, not merely royalties a licensee considers excessive. Where an investigation does open, what matters is the contemporaneous record: the business reasons documented when the licensing terms were set. A procompetitive rationale assembled after an inquiry begins tends to be undercut by the documents created at the time, which is why licensing decisions are better documented as they are made than explained afterward.

A dealer's "as is" wording cannot cancel statutory rights in an otherwise covered sale. These questions should be settled before counting repair visits.

Key Child Protection Rules under New York Domestic Relations Law

New York domestic relations law prioritizes the best interests of children through statutory frameworks that govern custody, visitation, support, and safety in family proceedings. Children in New York family law cases occupy a unique legal status: they are not parties to the litigation, yet the entire proceeding centers on their welfare, safety, and financial security. Courts apply a multi-factor best-interests standard when making custody and visitation decisions, weighing factors such as the stability of each parent's home, the quality of the parent-child relationship, and any history of domestic violence or substance abuse. Procedural protections, including the appointment of a law guardian ad litem in contested matters and the child's right to be heard, create formal mechanisms for children's voices and interests to reach the court, even when a child cannot retain independent counsel.
