Workers’ compensation is the exclusive remedy against the employer. Section 11 of the Workers’ Compensation Law bars a civil action against the employer and co-employees, with a narrow exception for grave injury in a third-party claim for contribution. The claim itself requires notice to the employer within thirty days under § 18 and filing with the Board within two years under § 28. A separate action lies against anyone other than the employer. Under § 29 the carrier holds a lien on the third-party proceeds for benefits paid, and settling the action without the carrier’s written consent or a court order jeopardizes future benefits. The lien is reduced by the carrier’s equitable share of litigation costs, so the net figure is not known until that apportionment is done.
