A work-related death triggers several proceedings at once, and they are better kept separate from the outset. Reporting comes first: a covered fatality within eight hours of the employer learning of it, and an in-patient hospitalization, amputation, or loss of an eye within 24 hours. A citation must then be contested within 15 working days of receipt, after which it becomes final and cannot be reviewed. Criminal exposure is often misunderstood. A willful violation of an OSHA standard causing death is a misdemeanor under 29 U.S.C. § 666(e) — up to six months. Felony risk comes from elsewhere: a state prosecution for manslaughter or criminally negligent homicide, or false statements and destruction of records during the investigation under 18 U.S.C. §§ 1001 and 1519. In practice the investigation creates more exposure than the underlying violation. On the civil side, Workers’ Compensation Law § 11 makes the death benefit the exclusive remedy against the employer; a wrongful death action lies against others and must be brought within two years of death (EPTL 5-4.1).
