A notice of claim is due within ninety days under General Municipal Law § 50-e, and the action itself must be commenced within one year and ninety days under § 50-i — not three years. Missing the notice is not always fatal; late filing may be permitted by leave of court, but that is an application rather than a right. A municipality may also demand a hearing under § 50-h before suit. Failing to appear can bar the action entirely. Different defendants, different rules. Claims against the State proceed in the Court of Claims under its own statute. Transit and housing authorities have their own requirements. Identifying the correct defendant early is what sets the calendar. And for actions commenced on or after May 26, 2026, the substantive rules changed. CPLR § 1411(b) now bars recovery in motor vehicle cases where the claimant's fault exceeds the defendant's — an exception to New York's pure comparative fault rule.
