Appealing an IRS audit requires checking the notice type, response deadline, and available procedures for challenging proposed tax adjustments. An IRS audit response deadline depends on the notice and stage of the dispute. Taxpayers may request an administrative appeal or seek court review when eligible. Missing a deadline can limit available options, so review the notice, supporting records, and filing requirements before responding.

CUP applies to transfers of tangible property. A services transaction is tested under the comparable uncontrolled services price method and a royalty under the comparable uncontrolled transaction method, so the first question in an audit is often whether the method matches the transaction rather than whether the comparables are good. No method has priority. Under the best method rule in § 1.482-1(c), the method that governs is the one producing the most reliable measure given the degree of comparability and the quality of the data. Comparability is assessed against the factors in § 1.482-1(d)(3) — functions performed, contractual terms, risks borne, economic conditions, and the property or services themselves. CUP demands close physical similarity of the product, which is why it is frequently displaced by the comparable profits method, which tolerates less product similarity by comparing profit level indicators instead. Where the tested result falls within the arm’s length range derived from the comparables, no adjustment is made; where the comparables are less reliable, the range is narrowed to the interquartile range. Separately, penalty protection under § 6662(e) depends on documentation that existed when the return was filed and is produced within 30 days of request — analysis prepared after the audit opens can support the position but not the penalty defense.
