Indicted on charges of special theft... 6 months in prison
Court: “Poor technique, damage cannot be recovered”
A teenager who tricked the seller into thinking he was buying an expensive luxury bag that was up for sale on a used trading app and then stole the item by tricking him into using a convenience store courier service was sentenced to prison.
On the 28th of last month, the Busan District Court sentenced Mr. A, who was handed over to trial on charges of special theft, to six months in prison.
In March of last year, Mr. A is accused of seeing a post on a second-hand trading app that said, “Luxury bags worth 5.9 million won are for sale,” approached seller B, had him deliver the bag to a convenience store, and then stole the item being prepared for delivery and ran away.
As a result of the investigation, it was confirmed that at the time, Mr. A visited a convenience store with a friend. The friend first broke a soju bottle in the refrigerator of the convenience store, attracted the attention of the employee, and used the opportunity to pick up a delivery box that was on the reception table and ran away.
The court acknowledged that Mr. A committed the crime, but sentenced him to prison on the grounds that the method was poor and no agreement with the victim or recovery of damage was achieved. A's history of receiving numerous juvenile protection measures for similar crimes was also taken into consideration in sentencing.
Lawyer Seoyoung Hwang of Daeryun Law Firm, who represented the victim, explained, “Mr. A intentionally deceived the victim by saying, ‘He was trying to buy a birthday present for his wife while on an overseas business trip,’ and induced the victim to make a delivery transaction rather than a direct transaction. The victim who tried to use the used goods trading app complained that he had suffered great financial and psychological damage.”
