A driver who was accused of damaging three parked cars while asleep while intoxicated was acquitted.
Cheongju Cheongwon Police Station in North Chungcheong Province announced on the 29th that it had decided not to send Mr. A, a man in his 30s, who was accused of driving a vehicle about 10 meters while drunk on a road in Cheongju last July and hitting cars parked in front.
At the time, Mr. A's blood alcohol content was over 0.1%, which was at the level of license revocation.
Mr. A denied the charges, saying that he started tossing and turning while sleeping to sober up and unintentionally stepped on the accelerator pedal.
Mr. A explained, "Because I was drunk at the time, I did not even realize that the collision occurred after stepping on the accelerator." He explained, "It was not an accident that occurred while driving while drunk."
A police official explained, "It is acknowledged that after drinking alcohol, the suspect sat in the driver's seat and turned on the engine and lights, and in that state, the vehicle was pushed forward and hit the victim," but added, "When checking the CCTV footage around the scene of the front black box of the victim, there are no circumstances showing that the suspect drove intentionally."
Lawyer Daeryun Dong-eun, a law firm representing Mr. A, said, "Under the Road Traffic Act, driving is 'using the road in accordance with the original method of use,' so it only applies to cases of intentional driving. In Mr. A's case, he did not start the car to drive, but got into the vehicle for the purpose of sobering up and sleeping, and we were able to lead to a non-transportation as it was revealed that it was the result of an unconscious action, not intentional."
