Q
It seems I have to pay settlement money for a sex crime. Do I necessarily have to entrust the settlement representation to an attorney?

A little while ago, I met a woman I liked and we drank together, and I did engage in some physical contact. But the next day, she contacted me saying she would report me for sexual molestation and demanding settlement money for a sex crime. At the time, she clearly said nothing in particular and did not seem displeased, so I was flustered when she came at me like this. She is demanding settlement money for a sex crime, so do I necessarily have to retain an attorney and entrust the settlement representation to them?

I see that you are troubled over settlement money for a sex crime. As in your case, if a person commits an indecent act against someone in a crowded place, they may be punished by imprisonment for up to 3 years or a fine of up to 15 million won.
If the victim is a minor or a person with a disability, the punishment is even more severe, so you must be careful.
For a sex crime, in addition to criminal punishment, if the sentence is a fine or heavier, it can even lead to disclosure of personal information such as one's name, age, address, and photograph, so a settlement with the victim is important in such a case.
If, through a settlement, the victim expresses an intention not to seek punishment, there may be room for a reduction of sentence, so if possible, we advise you to reach an amicable settlement with the victim.
And even if you have reached a settlement with the victim, punishment is a separate matter.
For sex crimes, the sentencing and aggravating factors are varied, so the defense strategy must be structured differently depending on the case.
In order to assess and apply the sentencing factors, including the settlement reached with the victim, it is advisable to retain a sex crimes attorney and respond to the case.
Therefore, we recommend that you retain an attorney from the settlement stage and then establish a defense strategy against punishment based on these sentencing factors.
