Q
How do I apply for relief from a drunk-driving license revocation?
Views65,117
Hello. A while ago, I drove drunk and my license was revoked. The problem is that since I make my living doing delivery work, if I cannot drive, I cannot work at all. If I drive in this state, it becomes driving without a license, so I cannot drive either, and I am going out of my mind. In a case like mine, is relief from a drunk-driving license revocation also possible?

I see that you have asked about relief from a drunk-driving license revocation.
According to Article 94 of the Road Traffic Act, it is provided that a person who has an objection to receiving a driver's license revocation disposition or a suspension disposition may file an objection within 60 days from the day of receiving the disposition.
In addition, under the Administrative Appeals Act, you may also apply for license relief through an administrative appeal.
In this case, you must apply to the competent court within 90 days after receiving the disposition.
However, in your case, you said that your license was revoked for drunk driving.
Because drunk driving is a crime that is strictly punished, you must carefully identify the factors for mitigation and respond to the relief application through a strategy based on them.
It would be advisable to receive the assistance of a drunk-driving attorney for this case. It seems possible to build a strategy emphasizing that the driver's license is absolutely necessary for your livelihood and highlighting the alcohol level or your past record.
For drunk driving, a different strategy must be built depending on whether it is a repeat offense and on how high the level was.
However, because it is difficult to know information such as your alcohol level at the time, whether an accident occurred, and whether it is a repeat offense, there are aspects on which a detailed answer is difficult.
Therefore, I recommend that you explain your situation in detail through a drunk-driving attorney and establish a response plan regarding the punishment.
