Q
I was caught for drug driving. Is there an attorney who knows the Narcotics Control Act well?

During a difficult period recently due to depression, at the recommendation of an acquaintance, I administered narcotics once. In that state, I drove a short distance, but I was caught by the police... and I am now under investigation. I did not cause an accident, and the driving itself was brief, so can I be punished heavily even in a case like this? I ask for a response from an attorney who knows the Narcotics Control Act well.

When driving a car, a motorcycle, or the like, narcotics, cannabis, and psychotropic drugs, as well as hallucinogenic substances such as butane gas, toluene, methyl alcohol, and nitrous oxide, are prohibited.
When a person drives in a state in which there is a concern of being unable to drive normally due to the administration, smoking, ingestion, or injection of a drug, the driver's license is revoked for a violation of the Road Traffic Act.
If a person is caught driving after administering narcotics, that person may be subject to imprisonment for up to 3 years or a fine of up to 10 million won.
Such legal sanctions reflect the seriousness of drug driving, and are intended to raise social awareness.
Driving after administering narcotics is a serious crime that can be punished as a violation of the Road Traffic Act and, at the same time, as a violation of the Narcotics Control Act.
Unlike ordinary drunk driving, if a narcotic component is detected in the body, it can lead to criminal punishment regardless of the purpose of driving.
Because such complex issues exist, it can be said that the assistance of a specialized attorney who has a deep understanding of the Narcotics Control Act is essential.
Please note that it is advisable to establish a systematic response strategy to reduce the punishment as much as possible.
