Q
I would like to know how corporate debt collection works.

Hello. I am a supplier that delivers goods to a business client. The client claims to be on the verge of insolvency and keeps putting off settling the price of the goods. Because their owner pleaded so earnestly, I did not collect for about three months, but now I have reached my limit. I would like to send a certified content mail regarding the price of the goods as a warning and file a civil lawsuit. Could you tell me the methods and procedures for corporate debt collection?

Hello.
You are considering corporate debt collection due to a client's nonpayment for goods.
In this case, sending a certified content mail is the first step.
A certified content mail for the price of goods is an official document sent when payment for delivered goods has not been received.
It is generally sent in the following situations.
- Where goods have been supplied but payment is not made within a set period
- Where the debtor keeps postponing payment indefinitely, citing circumstances, with no firm commitment
- Where there is no response despite verbal or text-message demands
In these situations, simple demands alone have their limits, so a certified content mail is used to leave a basis for future legal action.
In the certified content mail, you must clearly state ▸the contract date ▸the delivery details ▸the deadline for the payment request ▸the intended legal action in the event of nonpayment, and you prepare and send three copies at a post office or an online post office.
If payment is still not made after the certified content mail is sent, you may apply for a payment order or file a civil lawsuit based on supporting documents such as the contract and the transaction statement.
Depending on the circumstances, you may also need to consider applying for a provisional attachment of the debtor's property, so before proceeding with court-based debt collection, it is advisable to seek legal consultation promptly.
