Q
I am in a situation of unpaid wages... it has been several months.
Views9,590
Recently, I have experienced unpaid wages and have not received several months' salary. If it were a small amount unpaid, I would have let it go... but it is quite a large sum and it is infuriating, so I definitely want to collect it. Looking into it, I am told to file a lawsuit for unpaid wages, but since I know nothing, I feel lost. Attorney specializing in civil litigation, if I retain a lawyer, will I be able to get it back?

If a company fails to pay, on the date it agreed to pay, the wages it must give a worker in return for employment and labor, this constitutes unpaid wages.
Unpaid wages include cases where wages or bonuses are unilaterally cut, cases where a bonus is unilaterally treated as returned, and cases where severance pay is not paid within 14 days from the date of retirement.
A worker who has not been paid can, through a report, demand to receive the overdue wages or demand that the employer be punished for a violation of the Labor Standards Act.
If you want to file a report on the ground of unpaid wages, you can lodge a complaint with the labor office or, with the help of a lawyer, proceed with civil litigation.
In the complaint procedure for unpaid wages, you prepare the materials needed for resolution and report in person to the Ministry of Employment and Labor office having jurisdiction over the workplace, through which the facts are investigated.
If the employer continues to delay payment even after a report of unpaid wages has led to an order to pay the overdue wages, the employer will be subject to criminal punishment, and to recover the overdue wages, a civil lawsuit can be filed.
Because civil litigation procedures require complex procedures and legal knowledge that are difficult to handle alone, it is advisable to proceed with filing the civil lawsuit with the assistance of an attorney specializing in civil litigation who has extensive experience handling such cases.
When conducting civil litigation, we also, if necessary, act on your behalf in reaching a settlement with the employer and in applying for substitute payments.
