Q
Is the level of punishment heavier for a military personnel traffic accident?
Views7,582
As the title says, is the level of punishment stronger for a military personnel traffic accident than for an ordinary traffic accident? Currently, I am an officer.. I cannot describe the case in detail for fear of being identified.. but it is true that the traffic accident occurred due to my negligence. It was truly a mistake.... Before this case, I had no traffic accident record whatsoever. Could such factors be taken into consideration somewhat?... If it is a military personnel traffic accident.. should I request help from a military specialist attorney? I would appreciate an answer.

I will provide an answer regarding the level of punishment for a military personnel traffic accident.
In general, traffic accidents are handled under the Road Traffic Act and the Criminal Act, but a traffic accident involving an active-duty soldier may give rise to additional legal liability related to the soldier's status.
In particular, where a soldier causes an accident during military service (while performing official duties), they may bear heavier liability under Article 64 of the Military Criminal Act or other military-related statutes.
If a charge of occupational negligence causing death or injury is recognized due to the military personnel traffic accident, the person is subject to imprisonment without labor of up to 5 years or a fine of up to 20 million won.
In addition, depending on the details of the case, various disciplinary actions may be imposed, such as reprimand, salary reduction, suspension, demotion, dismissal, and removal from office.
When a soldier is involved in a traffic accident, various factors must be comprehensively considered, such as the type of vehicle driven, the circumstances of the accident, the type of license held, and the scale of the damage.
Although the same laws as for ordinary civilians apply, the special status of being a soldier may in fact work unfavorably.
Therefore, it is important to seek an appropriate solution by consulting a legal professional who well understands the status-related characteristics and legal situation of soldiers.
