Hello. I am a military criminal attorney at Daeryun Law LLC.
You must be very worried as you face an investigation on suspicion of violating the Military Uniform Control Act.
The Military Uniform Control Act is the abbreviation for the Act on the Control of Military Uniforms and Military Equipment.
According to Article 9(1) of the Military Uniform Control Act, a person who is not a service member must not wear a military uniform or use or carry military equipment.
Also, according to Article 9(2), no one may wear a uniform resembling a military uniform so as to make it difficult to distinguish the wearer from a service member, and a violation of this provision is punishable by a fine of up to 100,000 won, misdemeanor imprisonment, or a minor fine.
The concepts of misdemeanor imprisonment and a minor fine may be unfamiliar: misdemeanor imprisonment is a penalty of confinement in a detention cell for a period of not less than 1 day and less than 30 days, and a minor fine is a penalty requiring payment of an amount of not less than 2,000 won and less than 30,000 won, and it does not leave a criminal record.
However, if you receive a fine of up to 100,000 won, although the amount is small, a criminal record will remain, and to prevent this, you should seek the help of a relevant legal expert from the investigation stage.
