If you have repeatedly received malicious comments and comments containing false information on Instagram, filing an Instagram malicious comment complaint is entirely possible.
Malicious comments can go beyond mere criticism and become subject to criminal punishment, such as the crime of defamation or the crime of insult.
In particular, where false information is spread or defamation is repeated, the level of punishment may become higher.
If you wish to file a criminal complaint, you must first capture the full screen of the comments to collect evidence.
You must collect the information, including the author's nickname, the date and time of writing, and the post URL, and you must be able to confirm that it is the original.
As in the situation you described, where one person repeatedly posts malicious comments, you should save all of the comments posted on multiple occasions so that you can prove that the malicious comments were written continuously and repeatedly.
In addition, if you are experiencing stress or psychological distress caused by the malicious comments, it is helpful to prepare a medical certificate, counseling records, statements from acquaintances, and the like.
If you proceed with an Instagram malicious comment complaint and the perpetrator is found to have committed defamation by stating false information through an information and communications network, under Article 70 of the Network Act, imprisonment for not more than 7 years, suspension of qualifications for not more than 10 years, or a fine of not more than 50 million wonmay be imposed.
However, an Instagram malicious comment complaint can involve complex legal procedures, so we recommend that you respond promptly and accurately with the assistance of an entertainment attorney.
