To the criminal complaint attorney: I have been charged with infliction of bodily injury for transmitting a sexually transmitted disease.

Hello, criminal complaint attorney. The thing is, I had a sexually transmitted disease and I passed it on to my girlfriend. Can transmitting a sexually transmitted disease really lead to being charged with infliction of bodily injury? Isn't infliction of bodily injury a crime that is established only when you hit someone?

Hello. This is a criminal complaint attorney at Daeryun Law LLC.
Transmission of a sexually transmitted disease can also establish the crime of infliction of bodily injury and lead to a criminal complaint.
Under the Criminal Act, 'bodily injury' does not mean merely inflicting a wound on the external body.
An act that impairs the integrity of the victim's body or causes a disorder of their physiological function also constitutes bodily injury.
For example, the following cases can be recognized as infliction of bodily injury.
▷ Peeling off the epidermis of the skin
▷ Causing dizziness or vomiting through symptoms of poisoning
▷ Loss of teeth and the inducement of fatigue and lethargy
▷ Laceration of the hymen
▷ Infection with a sexually transmitted disease, and the like
According to Supreme Court precedent, bodily injury impairs the integrity of the victim's body or causes a disorder of their physiological function, and it need not necessarily be accompanied by an external wound.
For example, it is the position of the Supreme Court that symptoms resulting from an extreme psychological shock, such as post-traumatic stress disorder (PTSD), are also included in bodily injury.
As for the details, it is important to establish a response strategy after closely reviewing the circumstances of the case, whether there was intent, and the evidentiary materials through a consultation with a criminal complaint attorney.
If you have been the subject of a criminal complaint for infliction of bodily injury, you may wish to promptly proceed with a consultation with a criminal complaint attorney.
