When a public official traffic accident occurs, it does not stop at mere criminal punishment; it can also have a serious effect on maintaining one's status as a public official.
In fact, a public official traffic accident is regarded as grounds for discipline and may be followed by personnel disadvantages, and depending on the circumstances and seriousness of the accident, and whether there was negligence, various disciplinary actions may be imposed.
Discipline arising from a public official traffic accident may, in a minor case, end with a reprimand, but this does not stop at a mere admonition; promotion is restricted for 6 months.
In a more serious case, a salary reduction disposition may be imposed, in which case one-third of the salary is reduced for a period of not less than 1 month and not more than 3 months, and promotion is restricted for 12 months.
In a more serious matter, a suspension disposition is possible, in which case the status is maintained but the person cannot perform duties for 1 to 3 months and the full salary is reduced.
In the case of demotion, the person is demoted to a rank one grade lower and is excluded from duties for 3 months, the full salary is also reduced, and promotion is restricted for 18 months.
Furthermore, if a removal disposition is imposed, the person's status as a public official is revoked and reappointment is restricted for 3 years, and the most serious disposition, dismissal, entails the revocation of status along with a 5-year bar on re-entering public office.
Therefore, a public official traffic accident does not stop at a criminal matter but can have a serious effect on one's entire public service career, so responding promptly with the help of a legal expert from the early stage is more important than anything else.
