1. What Was the Story of the Client Who Sought the Uijeongbu Attorney Office?
The client who visited the Uijeongbu attorney's office was operating a moving company.
One of the customers filed a damages lawsuit, and the client needed the help of the Uijeongbu attorney. The Uijeongbu attorney looked closely into the circumstances of the matter.
The Client's Story as Examined by the Uijeongbu Law Office, Daeryun
The client was a veteran business operator who had run a moving company for more than 20 years.
One day, he received an inquiry about a move from a woman in her 40s.
The inquiry stated that her acquaintance, Ms. A, was considering a move but was currently busy with other matters, so she was requesting an estimate of the moving cost on Ms. A's behalf.
After reviewing the number of items Ms. A had, the client presented an estimate of 800,000 won.
At the time, however, no specific schedule had been set for when or where Ms. A would move.
Ms. A then expressed her intention to use a storage service for the household goods along with the packing and moving service.
The client presented to Ms. A a total amount combining the cost of moving out, the cost of moving back in, and one month of storage fees.
Ms. A accepted this, and Ms. A's acquaintance, who had been entrusted with the moving-related matters, paid the client part of the moving cost.
In this way, Ms. A's belongings were moved to the client's warehouse.

Even after a month had passed, however, Ms. A's side did not indicate any intention to remove the belongings. The client therefore requested storage fees for the extended period, and Ms. A's acquaintance remitted the corresponding amount.
Two months passed in this way, but there was still no word of Ms. A's move, and Ms. A's side did not pay the storage fees either.
At the request of Ms. A's side, who claimed to have circumstances, the client had not even collected the storage fees, and finally issued a final notice seven months later.
He stated that if the belongings were not removed, the items would be disposed of and applied toward the storage fees.
In response, the acquaintance on Ms. A's side also replied that they understood.
In the end, however, they did not remove the belongings, so the client sold some of the items on a secondhand market or discarded them.
The following year, however, Ms. A suddenly asked about her belongings, and upon hearing the client's reply that they had been disposed of, she filed a lawsuit for damages.
He therefore visited the Uijeongbu law office and requested the assistance of a specialized legal team.
Relevant Statutes Explained by an Attorney at the Uijeongbu Law Office
Civil Act Article 750 (Definition of Tort) A person who causes loss to or inflicts injury on another by an unlawful act, intentionally or negligently, shall be liable to compensate for the damages arising therefrom.
2. What Was the Uijeongbu Attorney Office's Winning Strategy?
The Uijeongbu lawyer's office established a specialized defense strategy so that the client could prevail in the case.
Uijeongbu Law Office Emphasizes the “Contract Provisions”
A claimed that, at the time of discussing the moving costs with the client, the parties had agreed that the storage fee would be paid upon moving into the new home.
This, however, was not true.
The contract drawn up between the client and A contained provisions on the storage of the household goods.
The provisions stated that, where the storage period is extended for reasons attributable to the customer, the relevant fee is to be paid in advance, and that, if there is no notice for three months after the expiration of the contract, the company may dispose of the stored items at its discretion.
In addition, when the client sent a text message requesting the extended storage fee, the client's acquaintance replied that he understood and also transferred one month's worth of the storage fee.
This means that A was also fully aware that the storage fee had to be paid in advance.
On the basis of these circumstances, the Uijeongbu attorney's office argued that A's claim should be dismissed.
Uijeongbu Law Office Emphasizes the “Client's Harm”
A did not retrieve his belongings for more than 3 years.
The storage fees that A should have paid amounted to 10 million won. A, however, did not pay them, and as a result the entire amount became a burden that the client had to bear.
In addition, because A's belongings filled the client's warehouse, the client was unable to accept new customers.
It was, in fact, the client who suffered harm from A's unilateral breach of contract.
The Uijeongbu attorney's office, citing these facts, represented the client.
3. What Was the Result of the Uijeongbu Attorney Office's Assistance? “Dismissal of the Plaintiff's Claim”
As a result of the Uijeongbu attorney's office systematically assisting the client, the court ruled in the client's favor, stating ‘the plaintiff's claim is dismissed.’
The court explained that this case's contract contained a provision under which, if there was no notice for 3 months after the expiration of the contract, the party consented to the discretionary disposal of the items stored in the warehouse, and that therefore it is reasonable to regard the client's sale of some of the moving items as a legitimate act under the contract.
