Unfair Competition Prevention Act Dispute | Favorable Judgment for a Client in a Lawsuit Over the Design Similarity of Household Goods

This is a case in which a manufacturer of household goods, in a dispute under the Unfair Competition Prevention and Trade Secret Protection Act, obtained a dismissal of the competitor's claim for an injunction against an act of unfair competition in the lawsuit brought by the competitor, through the assistance of Daeryun's corporate attorney with relevant expertise.

1. The Circumstances of the Unfair Competition Prevention Act Dispute

Daeryun corporate attorney, the circumstances of the Unfair Competition Prevention Act dispute

The client against whom a lawsuit was filed in connection with the Unfair Competition Prevention and Trade Secret Protection Act was a household goods manufacturer.

The client was sued in a lawsuit seeking an injunction against an act of unfair competition, but with the court's judgment dismissing the claim, was ultimately able to win the case and conclude the matter.

The Conflict Over the Product Packaging

The client who came to Daeryun's corporate attorney was a manufacturer of household goods.

Recently, the client had launched a new product emphasizing an eco-friendly image and was receiving a positive market response.

However, a competitor brought a lawsuit against the client seeking an injunction against an act of unfair competition under the Unfair Competition Prevention and Trade Secret Protection Act, alleging that the client had imitated a design similar to the competitor's existing product.

The problem was that, although the elements asserted by the opposing party were non-exclusive design elements widely used throughout the industry, the opposing party claimed them as its own distinctive design with source-identifying capability.

The client judged that what was needed was not a simple legal defense but a strategic response that comprehensively considered even consumer perception.

Accordingly, the client entrusted the case to a corporate attorney with practical experience in the fields of the Unfair Competition Prevention and Trade Secret Protection Act and fair trade.

2. The Unfair Competition Prevention Act and the Issues in the Case

The purpose of the Unfair Competition Prevention and Trade Secret Protection Act is to maintain a sound transaction order by preventing acts of unfair competition, such as the wrongful use of another person's trademark or trade name, and acts that infringe upon another person's trade secrets.

Article 2 of the Unfair Competition Prevention and Trade Secret Protection Act defines the following as acts of unfair competition.

▷ Using a mark identical or similar to another person's product mark so as to cause consumer confusion

▷ Acts that impair the distinctiveness or reputation of another person's mark

▷ Continuing to use, without any wrongful purpose, a mark identical or similar to another person's mark from before it became widely recognized within the country

▷ Misrepresenting the region of manufacture or processing of goods so as to mislead consumers

▷ Registering or using, without a legitimate basis, a domain name similar to another person's trademark or trade name

If a company suffers actual harm to its business as a result of an act of unfair competition, it may claim damages for such harm and may have the act stopped so that it does not continue.

▶ Unfair Competition Prevention and Trade Secret Protection Act, Article 5 (Liability for Damages for Acts of Unfair Competition, etc.)

A person who, by an intentional or negligent act of unfair competition, infringes upon another person's business interests and thereby causes loss shall be liable to compensate for such loss.

▶ Unfair Competition Prevention and Trade Secret Protection Act, Article 4 (Right to Claim Prohibition of Acts of Unfair Competition, etc.)

A person whose business interests are infringed or are likely to be infringed by an act of unfair competition may request the court to prohibit or prevent the act against the person who commits or intends to commit the act of unfair competition.

In the case of the right to claim prohibition, it must be exercised within three years from the date on which the person who committed the act of unfair competition became known, and the right is extinguished when 10 years have passed since the act of unfair competition.

What Are the Issues in the Case?

In the client's case, the opposing party had brought the lawsuit claiming, even though the design elements in question were elements generally used throughout the industry, that these were its own distinctive design.

(1) Whether the requirement of a ‘product mark widely recognized within the country’ is satisfied
The key issue was whether the product design asserted by the competitor had in fact been used exclusively and continuously for a long time in the relevant industry and had come to be uniquely recognized by consumers.

(2) The public nature of the design elements and industry practice
Another subject of judgment was whether the design elements at issue, such as natural images or color schemes, were general elements conventionally used throughout the industry, or were creative, distinctive, and original expressions.

3. Unfair Competition Prevention Act Dispute: Assistance Provided

Unfair Competition Prevention Act Dispute: Corporate Attorney Assistance

The corporate attorney focused on the point that legal infringement is difficult to recognize on the basis of design similarity alone, and established a strategic direction for the response based on industry practice, consumer perception, and analysis of visual distinctiveness.

In particular, he concentrated on proving the public nature of the design elements, excluding the possibility of confusion, and preparing grounds to rebut the opposing party’s arguments.

Interpretation of the Unfair Competition Prevention Act and Analysis of Precedents

The corporate attorney closely reviewed the relevant provisions and precedents of the Unfair Competition Prevention and Trade Secret Protection Act and analyzed whether the design elements of the client's product constituted a product mark widely recognized within the country.

On this basis, the attorney demonstrated that the legal grounds for the opposing party's claim were weak, thereby firmly establishing the foundation for a legal defense.

▶ Supreme Court, July 13, 2007, Judgment 2006Do1157

In order to qualify as a 'mark indicating the goods of another that is widely recognized within the country' and thus receive protection under the said Act, the form of the goods must, in comparison with other similar goods, possess a distinctiveness sufficient for an ordinary consumer to recognize at a glance that the goods belong to a particular business entity, such as by having a unique design feature that strongly appeals to consumers' senses, and furthermore the form of the goods in question must have been used continuously, exclusively, and on a monopoly basis as the goods of a particular business entity over a long period, or, even over a short period, through strong promotion and advertising, the distinguishing features of the goods' form must have reached the point of being so markedly individualized as to cause traders or ordinary consumers to associate the goods with a particular source.

Demonstrating the Common Nature of the Design Elements and Industry Practice

Through comparative materials, we proved that the design element at issue belonged to the general, non-exclusive public domain that is commonly used throughout the industry.

Through this, we made it clear that the design was not an original, distinctive expression, and we used this as a key basis for rebutting the other party's claim of exclusive rights.

In addition, we submitted to the court a report analyzing the history of past use and market practice, thereby enhancing the credibility of the public nature of the design.

4. Result of the Unfair Competition Prevention Act Dispute: “Favorable Judgment”

Unfair Competition Prevention and Trade Secret Protection Act dispute, result: dismissal of the plaintiff's claim

The court held that it was difficult to regard the design claimed by the other party as an original design, and difficult to find that the client's product had copied it, and dismissed the plaintiff's claim.

As a result, the client was able to continue normal distribution without halting product sales, and was also able to protect the brand image.
