Medical Advisory | A Case of Advising a Medical Practitioner at Risk of License Revocation and Defending Against the Revocation
This is a case in which a medical advisory helped a client at risk of revocation of a doctor’s license to keep the license. It is the result of a medical advisory regarding the charge of having engaged in medical treatment during a period of disqualification suspension.
1. The Client Who Requested Medical Advisory

This is the account of a client who requested medical advisory.
The client, who was working as a specialist at a well-known domestic orthopedic clinic, received a suspension of qualification disposition as a result of a series of events, and at the time was excluded from medical treatment work.
During that period, however, prescriptions were automatically issued in the client's name within the computer system, and some were even actually dispensed at pharmacies.
The client had never personally provided treatment for or signed those prescriptions, and the treatment was being handled exclusively by another physician on duty.
Based on this, the Ministry of Health and Welfare determined that the client had engaged in medical treatment during the suspension of qualification period and gave advance notice of a disposition revoking the medical license.
Stating that he felt deeply aggrieved, the client sought out a medical law attorney who had handled numerous medical-related cases to defend against the administrative disposition of license revocation, and requested assistance from Daeryun.
At Daeryun, an attorney who had handled numerous cases relating to the Medical Service Act took on the advisory for the client's case.
From the early stage of the case, Daeryun's medical law attorney organized the facts and, on the premise of the absence of intent or negligence on the part of the medical practitioner, established a clear strategy of proof and submitted explanatory materials to the administrative agency.
When Advisory Is Needed Due to License Revocation
If you face the risk of revocation of medical license, it is safer to respond after obtaining advice from a medical specialist attorney.
The grounds for revocation of medical license set out in the Medical Service Act are reviewed below.
Category | Ground | Details | Period and conditions |
Cases where a person cannot become a medical practitioner (license revoked if the person is already a medical practitioner) | Criminal punishment record | -After a sentence of imprisonment without labor or heavier, where the following apply | However, the crime of occupational negligence causing death or injury during a medical act is an exception |
Grounds on which the license may be revoked | Falling under a ground for disqualification | When a ground for disqualification, such as the above criminal punishment record, arises | Immediate revocation possible |
Medical act during suspension of qualification | Performing medical treatment during a period of suspension of qualification, or being subject to three or more dispositions of suspension of qualification
Prior history of license revocation | An act that is a ground for suspension of qualification after reissuance
Non-compliance with conditions | Failure to fulfill the conditions attached to the license
Lending of license | Where the license is lent to another person
Unlicensed procedure, etc. | Serious harm caused by an unlicensed procedure
Directing a medical act by an unqualified person | Directing a non-medical practitioner to perform surgery, transfusion, or general anesthesia, or directing an act exceeding the scope of the license |
2. Scope of the Medical Advisory Assistance

The medical advisory attorney collaborated with the firm’s digital forensics center to collect evidence to deny the charges against the client, who faced the risk of license revocation.
First, the medical attorney reviewed all treatment records related to the prescriptions issued under the client’s name.
The review found that all of the patients in question had been continuously treated by a fellow doctor, and the actual treatment records contained no signature or opinion of the client at all.
The medical advisory attorney decided to respond to the administrative disposition by collecting evidence to prove that this was a problem in the administrative system and that the client was not at the hospital at the relevant time.
Medical Attorney Analyzes the Structure of the Administrative System
The core of this case was the auto-input structure of the hospital's administrative system.
The prescription form was set up so that the practitioner's name and seal were automatically reflected as the system default, and as a result of administrative staff or nursing personnel processing it without correcting this, the practitioner's name remained in the computer records even though the practitioner had not actually been involved in the treatment.
The medical attorney technically analyzed this structural defect in the administrative system and the practical error, and presented, together with supporting materials, the point that the practitioner could not have recognized or controlled the problem in advance.
Medical Attorney Proves Absence Based on Digital Forensics
The medical attorney collaborated with the firm’s digital forensics center to scientifically prove the client’s absence from the hospital at the time of the incident.
As a result of a comprehensive analysis of the client’s mobile phone location records, SNS upload times, and call and message logs, it was confirmed that the client was outside the hospital at the time the disputed prescription was issued.
These forensic materials were submitted as key evidence supporting the fact that the client had not actually performed the medical act.
3. Result of the Medical Advisory, the Client Was Able to Keep the Medical License
As a result of the medical advisory, the client was able to safely keep his medical license.
This case is one in which the defense logic was completed by combining precise interpretation of the medical records with analysis based on digital forensics.
Revocation of a medical practitioner's license is a serious matter that goes beyond a mere sanction and can mean losing a lifelong occupation and career.
In particular, where systemic problems such as the automatic-entry structure of the hospital computer system or internal administrative errors are involved, the key is to prove the absence of intent and negligence and to clarify where responsibility lies.
Even a computer record showing that a prescription was issued under a medical practitioner's name may be regarded as a substantive medical act, so a meticulous rebuttal logic must be constructed by combining computer logs, medical records, revenue records, forensic analysis results, and the like.
At Daeryun Law Firm, medical law attorneys collaborate with the digital forensics center to carry out scientific data analysis and technical proof on a one-stop basis.
