MoCRA Compliance: what usually happens

Who carries the obligations

MoCRA places many of its duties on the responsible person, which is generally the company whose name appears on the product label. Facilities that make cosmetics for the American market have their own registration duty, so a brand and its contract manufacturer can each carry obligations for the same product. The responsible person lists products with the FDA and must report serious adverse events. The law also expects that company to be able to show that each product is safe to use as labeled. Certain small businesses are exempt from some requirements, but the exemption does not reach every product type, so it should be checked rather than assumed. Products that are both cosmetics and drugs, such as sunscreens or anti-dandruff shampoos, remain largely governed by the drug rules.

Building the safety file

Safety substantiation is where many brands find gaps. Supplier ingredient data, testing results, and published research can all contribute, but they need to be organized product by product and tied to how each product is actually used. Labels now need contact information through which consumers can report adverse events, and older packaging may not have it. Some parts of the law depend on FDA rules, including manufacturing practice standards and fragrance allergen labeling, and their timing has shifted, so their current status needs checking. Keep complaint and adverse event records in a system that lets you see patterns, since the FDA can ask for access to them in some situations.

Reviewing a product line

We begin with your products, the facilities that make them, and how your labels identify the company responsible. That tells us who should be registering, listing, and reporting, and whether any exemption realistically applies. We look at your contracts with manufacturers and fillers to see whether they assign these tasks clearly and give you the information you need. If you sell imported products or sell through online marketplaces, we look at how those channels change the picture. For most brands, MoCRA compliance becomes a manageable routine once responsibilities are written down and assigned to someone by name.
