Who may answer for the product
Responsibility can extend to the manufacturer, the maker of a defective component, the distributor, and in many cases the retailer that sold the item. Online marketplaces raise their own questions, because courts are still working out when a platform counts as a seller. Claims are commonly framed around a flaw in the design, a problem in how a particular unit was made, or warnings and instructions that fell short, and a single case may combine these theories. Foreign manufacturers add questions about jurisdiction and service of process that can affect timing.
How the case usually unfolds
After the complaint and the response, discovery covers design files, testing data, complaint histories, and prior incidents involving the same product. Engineering and medical testimony usually becomes central, and each side retains its own technical witnesses to explain how the product failed or why it did not. Inspections are often done under an agreed protocol so that neither side can be accused of altering the evidence. Many cases resolve through negotiation or mediation once the technical evidence is developed, while others proceed to trial. Because of that technical work, product cases often move more slowly than other injury cases, and planning for that pace is part of the conversation from the start.
Defenses and limits to expect
Manufacturers often argue that the product was misused, modified, or worn out, or that something else caused the injury. For some medical devices approved through the FDA's most demanding review process, federal preemption can sharply narrow the claims that remain. A recall can be useful context, but it does not by itself establish that a particular product caused a particular injury. Deadlines vary by claim and by state, and both the date of injury and the date you learned of its cause may matter.
