An IND takes effect by operation of time. Under 21 CFR 312.40 the sponsor may begin the trial thirty days after FDA receives the IND unless the agency notifies it otherwise. A clinical hold under 312.42 is a separate order, which FDA may impose at any point and which stops the study until it is lifted. Safety reporting during the IND runs on two clocks. Under 312.32 an unexpected fatal or life-threatening suspected adverse reaction is reported within seven calendar days, and other serious and unexpected suspected adverse reactions within fifteen. After approval, 21 CFR 600.80 requires fifteen-day alert reports for serious and unexpected events, with periodic reports thereafter. A BLA is reviewed on PDUFA timelines, ten months from the sixty-day filing date for a standard review and six for priority.
