Three theories reach the same product, and they expire at different times. Strict liability asks about the product. The plaintiff need not show the manufacturer was careless — only that the product was not reasonably safe and that the defect caused the injury. Negligence asks about the conduct: whether reasonable care was used in design, manufacture, or inspection. In design cases the two analyses largely converge. Breach of warranty is contract law, which changes both what is recoverable and when. It reaches purely economic loss that tort claims do not, and it runs four years from delivery under the UCC — not from when the defect appeared. A claim time-barred in tort may survive in warranty, and the reverse happens just as often. Damage to the product itself is not a tort claim. Where a product fails and injures only itself, New York confines the claim to contract and warranty. The distinction between a product that breaks and a product that breaks something else determines which theories are available at all. Liability runs down the chain. Manufacturers, importers, distributors, and retailers are each subject to strict liability — which matters when the manufacturer is offshore or insolvent, and which is why indemnity arrangements among them become a second dispute inside the first.
