What Is Bequeathment and How Does It Work in Your Estate Plan?

The label on a gift determines what happens when the estate cannot pay for everything. A specific bequest names a particular asset. A general bequest names an amount. If the estate falls short, residuary gifts are reduced first, then general gifts, and specific gifts last. Leaving "$100,000" and leaving "the balance of my account" produce very different results in a shrinking estate. A specific gift fails entirely if the asset is gone. Sell the apartment you left to your son, and the gift adeems — he receives nothing, and the will does not substitute cash or another property. What happens if a beneficiary dies first depends on who they were. New York's anti-lapse statute redirects the gift to the beneficiary's children, but only where the beneficiary was the testator's sibling or descendant. For anyone else, the gift lapses into the residuary. And a spouse cannot be written out. A surviving spouse may elect against the will and take a statutory share regardless of what the document provides. Any plan that disinherits a spouse has to account for this, or it produces litigation instead of the intended distribution.

How an Unpaid Wages Attorney Helps Control Defense Costs

The multiplier is statutory, not negotiable. Under 29 U.S.C. § 216(b) an employer found liable for unpaid overtime owes an equal amount in liquidated damages unless it establishes good faith and reasonable grounds for believing it complied, and New York Labor Law § 198 provides the same hundred percent on a state claim. The period differs by statute. The FLSA reaches two years, or three for a willful violation, while the Labor Law reaches six. Most claims are therefore pleaded under both, and the state period is what determines the size of the exposure. Records decide the outcome. Where the employer has not kept the time records § 211(c) requires, the employee may establish hours by reasonable inference under Anderson v. Mt. Clemens Pottery (1946), and the burden shifts to the employer to negate that showing. A payroll audit conducted before the claim is answered is what makes that burden meetable.
