Fraud is one of the four statutory grounds. Under 9 U.S.C. § 10(a)(1) an award may be vacated where it was procured by corruption, fraud, or undue means, and the courts apply a three-part test: the fraud must be shown by clear and convincing evidence, it must not have been discoverable by due diligence before or during the hearing, and it must be materially related to an issue in the arbitration. The deadline is short and jurisdictional in effect. Notice of a motion to vacate must be served within three months after the award is filed or delivered under § 12, and a party that lets the period run generally cannot raise the same grounds defensively when confirmation is sought. An award under the CPLR follows a different clock, with ninety days from delivery under CPLR 7511. Correcting the record is narrower than reopening the merits. A court reviewing a § 10(a)(1) petition does not reweigh the evidence, and a false statement by a witness is not itself a ground where the issue was litigated before the tribunal. Where the award has already been confirmed, relief runs through Rule 60(b)(3) on the judgment, subject to its one-year limit.
