If a traffic accident occurs intentionally due to retaliatory driving, special property damage and special injuries are applied.
Police: “There was no retaliatory driving behavior, and it was the first time driving in a lane reduction zone… poor driving.”

There was a case where the police decided not to forward a driver in his 20s who was suspected of intentionally causing a traffic accident while driving in retaliation.

It was confirmed that the Daegu Eastern Police Station recently decided not to send Mr. A, in his 20s, who was booked on charges of special property damage and special injury, without charges.

Mr. A was booked on charges of intentionally causing an accident by driving in retaliation by changing lanes in anger when the driver of the car behind honked his horn while driving on the highway in October 2024.

During the investigation, Mr. A completely denied the charges, saying, “The accident occurred because I was not used to driving, and there was no intention.” At the same time, he emphasized that he was so inexperienced at driving that an accident occurred in January 2024 in which he crashed his vehicle into a building.

The police who investigated this case determined that Mr. A was not guilty. As the reason for not sending the case, the police said, “The black box video at the time of the accident did not show typical signs of retaliatory driving, such as rapid acceleration or rapid deceleration,” and “the suspect did not express any bad feelings, such as swearing at the victim, in the vehicle.”

The police also said, "Considering that the suspect's driving history was not long, the accident occurred on the first road, and the fact that the suspect got out of the vehicle and filed a report with the insurance company immediately after the accident, it appears that the suspect was trying to overtake rather than threaten," and concluded, "It is difficult to admit that the suspect's actions were clearly intended to cause harm to the victim."

Attorney Song Seok-min of Daeryun Law Firm (Limited), who represented suspect A in this case, said, “If a traffic accident is caused intentionally, such as by retaliatory driving, special property damage or special injuries may be applied depending on the degree of damage.” He added, “In this case, as inexperienced driving was accepted as the cause of the accident, Mr.
