A man in his 40s was sentenced to a fine after being sent to trial on charges of being drunk and causing a disturbance at a restaurant and interfering with the work of the police who responded.

On December 11 last year, the Cheonan branch of the Daejeon District Court sentenced Mr. A, an office worker in his 40s, to a fine of 7 million won, who was indicted on charges of obstruction of business and obstruction of official duties.

Mr. A is accused of disrupting business by causing a disturbance at a restaurant in August of last year, including swearing at employees and other customers while drunk.

In addition, Mr. A was also accused of obstructing the execution of official duties, such as arguing with the police who responded to the report and blocking the operation of the patrol car.

The court sentenced Mr. A to a fine. The court said, “The defendant was drunk and interfered with other people’s work, and he used physical force against the dispatched police officer to interfere with his duties. Considering the circumstances of the crime, the nature of the crime is serious.”

However, the court stated the reason for sentencing, saying, “The defendant reached an agreement with the restaurant owner and deposited a small amount of money for the victim police officer,” and “We took into account the fact that he has no history of being punished for the same crime and is reflecting on his mistakes.”

Lawyer Lim Hye-jin of Daeryun Law Firm (Lihan), who represented Mr. A, said, “If you assault or threaten a public official such as a police officer or firefighter, you will be charged with obstruction of official duties, which is punishable by imprisonment for up to 5 years or a fine of up to 10 million won.”

He added, “Based on this, it appears that the court judged that there was no risk of reoffending for Mr. A and handed down a sentence lower than probation.”
