동거인에 생활비 준 40대 ‘강제집행 면탈’ 기소…법원 “은닉 의도 없다” 무죄 선고

A 40-year-old woman accused of hiding property to avoid execution due to default was acquitted after proving she had no intent to conceal it.

According to the legal community on the 22nd, the Seoul Central District Court found Mr. A, in his 40s, not guilty on the 9th of last month on charges of evasion of compulsory execution.

Mr. A was brought to trial on charges of concealing 25 million won for one year starting in 2020 for the purpose of avoiding compulsory execution of the debt. Previously, the court had decided to pay Mr. A the loan amount to creditors and register him on the list of defaulters.

The prosecution determined that Mr. A hid his assets by transferring his salary, etc. to an account in his name and transferring it to his partner's bank account. Also, during this process, it was determined that Mr. A applied for rehabilitation by taking advantage of the decrease in total assets.

However, Mr. A denied the charges, saying that he only sent living expenses to his housemate, and that he also received money from his housemate when he was short of money. He also claimed that there was no intention to hide his assets because he submitted all salary ledgers and account transaction details to the court when going through rehabilitation procedures.

The court ruled that the amount sent by Mr. A to his housemate could not be considered excessive for the living expenses of two adults, and that it was an economic community in which money was exchanged with the housemate depending on the economic situation. Even when going through rehabilitation procedures, it was judged that detailed usage details of the transferred amount were submitted to the court for a decision.

Attorney Kim Won-sang of Daeryun Law Firm, who represented Mr. A, said, “If Mr. A had tried to harm his creditors, he would not have received his salary in cash and created account transfer details, but he did not do so and submitted the account transfer details as is to the rehabilitation court. It appears that the court found him not guilty.”
