A report was filed with the Fair Trade Commission stating that the Korean Bar Association's regulations on restrictions on artificial intelligence (AI) advertising are excessive regulations and require sanctions.
Daeryun Law Firm announced on the 22nd that it submitted a report on prohibited acts by business organizations to the Fair Trade Commission containing the Korean Bar Association's violation of the Fair Trade Act.
Earlier this year, Daeryun unveiled ‘AI Daeryun’, an artificial intelligence-based legal service developed in-house, and began full-scale operation.
In response, the Korean Bar Association expressed its intention to take disciplinary action, saying it would take strict action after determining the facts.
Afterwards, Daeryun filed a constitutional appeal with the Constitutional Court, saying, “The Bar Association’s advertising regulations are infringing on the freedom to practice one’s profession.”
Currently, the Constitutional Court has referred the case to the full court for review.
According to Article 5 of the ‘Rules on Lawyer Advertisements’ established by the Korean Bar Association, lawyers, etc. cannot advertise in a manner or content that allows consumers to directly use programs such as artificial intelligence or connects consumers to programs such as artificial intelligence.
In addition, through Article 6 of the 'Regulations on Lawyer Advertising', which sets out specific details regarding the relevant rules, the Korean Bar Association stipulated that, in accordance with Article 5 of the Rules, lawyers, etc., who advertise the fact that they use artificial intelligence in their work, must register the relevant artificial intelligence system in advance in accordance with the Association's certification standards.
Daeryun judged that the Korean Bar Association's regulation of artificial intelligence advertising directly violated the 'minimum regulation principle', which is a core principle of lawyer advertising regulation.
In addition, the Korean Bar Association stipulates that the association's certification standards must be followed when advertising the use of AI programs by lawyers, but it has been pointed out that the lack of proper certification standards is currently resulting in the same result as a complete ban.
Attorney Daeryun Son Gye-jun, who submitted a report to the Fair Trade Commission on this day, said, "We tried to enable information-vulnerable groups to receive quick and accurate legal advice through AI technology, but the Korean Bar Association's current regulations make it impossible to even disclose this to the outside world, seriously limiting consumers' right to know."
Attorney Son emphasized, "The legal market is also in an age where innovation is needed. AI-based legal services are already becoming common in global legal markets such as the U.S. and the U.K. The domestic legal community must also keep up with this trend, and consumers have the right to receive better services." He added, "Although there is an opportunity to improve through AI and digital technology, the Korean Bar Association is blocking this at the source through regulations. This report stems from the hope that the legal market will grow healthily through reasonable regulation."
