Hosted by Rep. Kim Woong of the United Future Party (Songpa-gu-gap, Seoul), the ‘Policy Debate for Preparing a Law to Eradicate Gender-Based Violence and Murders’ was held today, Friday, July 3, at 10 am in the first seminar room of the National Assembly Building.

In his opening speech, Rep. Kim Woong started by talking about his time as a prosecutor and explained the purpose of organizing the policy debate, saying, “Although overall crime in our country has decreased significantly, dating violence, stalking, and violence against sexual minorities have increased and worsened into social problems.”

The discussion began with a keynote presentation by Lee Mi-jeong, a senior researcher at the Korea Women's Policy Institute, and Shim Jae-guk, a representative attorney at Daeryun Law Firm. Next, a panel discussion was held with Kim Han-gyun, senior research fellow at the Korea Institute of Criminology, Jeon Yun-jeong, legislative researcher at the National Assembly Research Service, Kim Do-yeon, director of the Korea Dating Violence Research Institute, and Jo Yoon-oh, professor at Dongguk University's School of Police and Judicial Law.



Jae-guk Shim, CEO of Daeryun Law Firm, who gave the keynote presentation, presented the need for improvement in the legal system as felt through actual cases of dating violence and progress in each case.

Attorney Shim introduced cases of dating violence that he actually carried out and said, “In the case of dating violence, there are some cases that end in insufficient evidence and non-indictment due to the perception and prejudice that consent to sexual violence and assault is prerequisite due to the fact that the case is a romantic relationship. Therefore, it is necessary to establish victim protection regulations and improve the law that take into account the special nature of dating violence.”

He continued, “Under the current law, because the name of the crime is not specified, dating violence is regulated by special laws such as the Criminal Act and the Special Act on the Punishment of Sexual Violence Crimes. However, in the case of dating violence, it often occurs habitually due to a combination of emotional, physical, and sexual abuse, and in many cases, it is difficult to accept under the current law.” He emphasized, “It is necessary to establish regulations that specify the meaning and scope of dating violence, establish a complex relationship with the crime, and review aggravated punishment.”

In addition, “In terms of dating violence and victim protection, even if it is a civil procedure to apply for a temporary injunction, it takes at least two months, so damage relief is delayed and effectiveness is somewhat lacking,” he added. “Clear and effective victim protection regulations are needed to make up for the shortcomings in protecting victims of dating violence.”
