Disciplinary Procedure for Public Officials

① Detection of the misconduct
→ When a public official's misconduct is detected, the person with disciplinary authority investigates the facts.

② Request for a disciplinary decision
→ Within 1 month from the date of being notified of the investigation results, a disciplinary decision must be requested with respect to the person suspected of misconduct.

③ Disciplinary decision
→ The request for a disciplinary decision takes effect when the competent disciplinary committee receives the written request for a disciplinary decision.

After receiving the statement of the suspected person and conducting a factual investigation, a notice of attendance is given to the suspected person up to 3 days before the disciplinary committee is held.

④ Notification of the disciplinary decision
→ The decision of the disciplinary committee is immediately notified to the person with disciplinary authority, and the disposition is confirmed.

⑤ Objection
→ If the person authorized to request a disciplinary decision objects to the decision of the disciplinary committee, that person may, within 15 days from the date of being notified of the written disciplinary decision, request review or re-examination by the disciplinary committee established at the immediately superior agency.
