Civil Act Article 1019 (Period for Acceptance or Renunciation)

(1) An heir may make a simple acceptance, a qualified acceptance, or a renunciation within 3 months from the date on which the heir becomes aware of the commencement of inheritance. However, that period may be extended by the family court upon the request of an interested party or a prosecutor.

- What must be remembered is the period of '3 months.' The decision on whether to accept the inheritance must be made within 3 months without fail.

(2) An heir may investigate the inherited property before making the acceptance or renunciation under paragraph (1).

(3) Notwithstanding paragraph (1), where an heir has made a simple acceptance without being aware, in the absence of gross negligence, within the period that the inherited debt exceeds the inherited property, the heir may make a qualified acceptance within 3 months from the date on which the heir becomes aware of that fact. *** Special qualified acceptance

- 'Gross negligence' means that, although the heir could have known that the inherited debt exceeded the inherited property had the heir exercised even a little care, the heir failed to do so and therefore did not become aware of that fact (Supreme Court Judgment of June 10, 2010, 2010Da7904).

- '3 months' is the basic principle, but there are also cases in which the deceased's debt, which could not have been known at the time, is later discovered- . In such cases, 'special qualified acceptance' should be considered.
