1. The Client Who Became the Respondent in an Affair Lawsuit
The respondent client, who had been sued as the male affair partner, sought an attorney's assistance, explaining that the client faced the prospect of paying 30 million won in consolation money.
To assist with the client's case, the attorney separately reviewed the accounts of both the plaintiff who had filed the lawsuit and the client.
The Plaintiff's Assertions
The plaintiff who filed the affair lawsuit against the client asserted that the plaintiff's wife and the client had been in a romantic relationship.
The plaintiff asserted that the plaintiff's wife and the client had not only exchanged inappropriate text messages and traveled together but had also continued an affair, including sexual relations.
The plaintiff further stated that, because of the respondent in the affair lawsuit, the plaintiff's marriage had broken down and the plaintiff had suffered great emotional distress.
Accordingly, the plaintiff asserted that the client, who had caused the plaintiff emotional harm, should pay at least 30 million won in consolation money.
The Client's Assertions
The client asserted that the client had never engaged in an affair, such as having sexual relations, with the plaintiff's wife.
The client asserted that, although the client had gone on a business trip with the plaintiff's wife as a coworker, the two had never once traveled together for an inappropriate relationship.
2. The Respondent's Liability in an Affair Lawsuit
The client had been sued in an affair-related damages lawsuit.
Through an affair-related damages lawsuit, a person may claim damages for the emotional harm caused by one's spouse's affair partner.
Accordingly, the plaintiff who filed the lawsuit against the client did so on the ground that the plaintiff had suffered emotional harm from the affair between the plaintiff's wife and the client.
3. Defense of the Respondent in an Affair Lawsuit
To defend against the consolation money claim against the client, who had become the respondent in the affair lawsuit, the attorney argued as follows.
The Plaintiff's Wife Exchanged Messages for Work Purposes
The attorney emphasized that there was nothing inappropriate in the messages exchanged between the client and the plaintiff's wife.
While the plaintiff's wife did exchange messages for work purposes, the content showed no affection at all, and it instead confirmed that the plaintiff's wife had one-sidedly developed feelings for the respondent.
In addition, the client typically maintained boundaries when exchanging messages and rarely engaged in personal conversation beyond work.
There Was No Fact of Traveling With the Plaintiff's Wife
The attorney emphasized that the client had not traveled with the plaintiff's wife and denied any affair.
The client and the plaintiff's wife had gone on a business trip as coworkers, and each had booked a separate room and attached the lodging receipts to receive travel expenses from their workplace.
The Client Is Suffering Harm Because of the Plaintiff
The attorney emphasized that the plaintiff suspected a relationship between the client and the plaintiff's wife and informed the respondent's workplace of this, causing the client harm.
At present, the client faces serious harm, as the false information spread by the plaintiff has made the client's working life difficult.
The attorney established that the client had not been in a romantic relationship with the plaintiff's wife and had never engaged in any improper conduct.
4. Result of Defending the Respondent in an Affair Lawsuit: "The Plaintiff's Claim Is Dismissed"

After hearing the attorney's argument, the court issued the following judgment.
2. The litigation costs shall be borne by the plaintiff.
The court issued this judgment, finding it difficult to conclude that the 🔗affair lawsuit respondent and the plaintiff's wife had been romantic partners beyond coworkers.
This result was obtained because of the attorney's assistance. If, like the client in this case, you face the prospect of unfairly paying consolation money, please request assistance at any time.
Drawing on data from affair lawsuits, the attorney will work to bring about a favorable result.
