Q
Can I receive a suspension of indictment in a drug case?
Views57,642
I was caught as a first time drug offender and have to undergo a police investigation because of this. Some time ago, I went to a club with a friend, and while drunk I think I smoked what seemed to be a cigarette, but it turned out that it was a drug. Since I was drunk, I did not even know it was a drug. Honestly, I cannot remember well, and I am going crazy from the injustice. If I am a first time drug offender, can I receive a suspension of indictment? Please respond.

I see that you are facing a police investigation as a first time drug offender. Drugs are dealt with as a serious crime by the State, and it is a crime for which even mere possession results in strict punishment.
In your case, since you did not tell me exactly what drug was administered, a detailed answer is difficult, but I first inform you that the level of punishment may vary depending on the drug administered.
Even without using such narcotics, mere possession can lead to punishment.
The punishment ranges from imprisonment for a limited term of at least one year to imprisonment for up to 5 years or a fine of up to 50 million won, and the level of punishment is far higher than in other cases.
Even for a first time drug offender, it can be difficult to avoid punishment, so the assistance of an attorney specializing in drug cases is all the more necessary.
If you are still before the police investigation, it is advisable to be accompanied by an attorney specializing in drug cases to avoid unfavorable statements and to present sentencing factors.
In your case, a case strategy can be developed based on factors such as being a first time drug offender and having a low likelihood of reoffending, so please prepare a strategy that can reduce the punishment or defend against it through a detailed consultation.
