I would like to know in detail how drug offender sentencing works. In particular, can an actual prison sentence be imposed even for a first-time offender or for a person who has inhaled a small amount of narcotics? I would be grateful if a cannabis attorney could explain in detail whether a narcotic such as cannabis also carries a high level of punishment and what punishment applies in the case of a repeat offense..!

Hello, this is a cannabis attorney. A drug offender refers to a person who has administered or possessed narcotics, psychotropic drugs, and other controlled substances.
If a person possesses a narcotic that falls under category (a), such as philopon, heroin, or cocaine, that person is subject to imprisonment of five years or more.
Next, if a person possesses a narcotic that falls under category (b), such as fentanyl, morphine, or methadone, that person is subject to imprisonment of three years or more.
Lastly, if a person possesses a narcotic that falls under category (c), such as zolpidem or etizolam, that person may be subject to imprisonment of one year or more.
In addition, if a person sells narcotics, that person may be subject to imprisonment of five years or more or life imprisonment.
As for drug offender sentencing, the sentence may be mitigated if there are special extenuating circumstances regarding participation in the offense or the motive, if the act was a one-time occurrence, or if the person participated passively in the offense.
Conversely, if a person has a prior narcotics conviction or is caught administering narcotics again during a suspended sentence period, the drug offender sentencing may become even heavier.
By mistake, even an act begun out of mere curiosity can lead to severe criminal punishment. It is very important to analyze the case accurately with a cannabis attorney and respond systematically.
