I am a job seeker, and because I had no money, I looked at a part-time job site and started an office part-time job with a fairly high hourly wage. But the boss kept calling them clients and telling me to print out documents he gave me, hand them over, and collect cash. Something did feel strange. The boss said it was all legal work and there was no need to worry, but a few days ago I received a call telling me to come in for a voice phishing police investigation. I really did not know it was voice phishing. What should I do about this? Please help me.

Hello. This is a criminal attorney at Daeryun Law LLC.
I cannot know every detail of your situation as you face a voice phishing police investigation, but judging only from the content of your question, it appears that you acted as a cash collector for the voice phishing.
A voice phishing cash collector may be subject to the crime of fraud or the crime of aiding and abetting fraud.
In addition, because you printed out and delivered documents, the crime of forgery of a private document and the crime of uttering a forged private document may also be recognized.
The crime of fraud is punishable by imprisonment for not more than 10 years or a fine not exceeding 20 million won, and the crime of forgery of a private document is punishable by imprisonment for not more than five years or a fine not exceeding 10 million won.
You cannot be cleared of the charge merely by saying that you did not know it was a voice phishing organization.
The Supreme Court's judgment in case 2024Do13466 quashed the lower court's judgment of acquittal, holding that a voice phishing cash collector can be punished as a co-principal in fraud even without specifically recognizing the method or content of the crime, and remanded the case to the Daejeon District Court.
Therefore, you should seek the assistance of a criminal attorney and prepare a response strategy.
A criminal attorney provides not only accompaniment at the voice phishing police investigation but also the following assistance.
▶ Preparing a strategy to deny intent
▶ Collecting valid evidence together with an evidence-examination expert
▶ Handling settlement with the victim and advising on the criminal deposit system
▶ Advance simulation of the voice phishing police investigation
If you are facing a voice phishing police investigation, you are welcome to request a consultation as soon as you are able.
