How a holiday night becomes a domestic case

Domestic violence cases in New York are not limited to spouses; they can involve dating partners, former partners, relatives, and people who share a child. A dispute over a party, a costume, or a schedule can lead to a call, and when police see signs of injury or hear an account of one, an arrest often follows. Officers are expected to try to identify the primary aggressor, not simply the person who called. Alcohol and crowded gatherings make accounts harder to sort out, which is one reason the first police report is not the end of the story. Expect the judge at arraignment to consider an order of protection, often before you have said a word about what happened.

When the order collides with holiday plans

An order of protection can bar you from your own home and limit contact with the other parent, which immediately complicates trick-or-treating, school events, and the parenting schedule. Do not work out an informal exception, even if the other parent invites you; a custody or parenting arrangement does not override the order of protection unless the order itself allows contact under a court-ordered custody or visitation schedule. Keep the order, any custody order or written parenting agreement, and messages about the holiday schedule. If children were present that night, tell your lawyer, because that can affect both the criminal case and any Family Court matter. Child exchanges usually have to be arranged in a way the order permits, such as through a third party, if it permits one at all.

Sorting out the weeks after the holiday

The criminal case, a possible Family Court petition, and any existing custody arrangement can all be affected by one night, and they move on separate tracks. We start by reading the exact terms of the order and working out what has to be arranged right away, such as a place to stay and how the children will see each parent. We then look at the evidence from the night, including photos, party videos, and people who were there. Where appropriate, we can ask the court to modify the order so ordinary parenting can continue safely. Immigration status and firearms are reviewed as well, since domestic cases frequently affect both.
