A separate survival claim may seek damages for the deceased person's own conscious pain and suffering before death. The filing window for wrongful death is shorter than for many injury claims, and claims against public entities carry an earlier notice requirement.

First steps for the defense

Notify every insurer that may cover the claim right away, including auto, homeowner, commercial, umbrella, and professional policies, because late notice can create a coverage dispute on top of the lawsuit. Preserve vehicles, equipment, video, maintenance records, and electronic data in their current state, and do not repair or dispose of anything involved. Do not speak with the family, their lawyers, investigators, or the press about the incident until you have advice, however much you may want to express sympathy.
