Q

Can an act done in the belief that one was alone still constitute public indecency?

Legal IntellectualViews4,253

I did something inappropriate thinking there was no one around, but afterward I was told that I have to undergo an investigation because someone reported it. At the time, I thought there was no one nearby, and I had no intention whatsoever of letting anyone see. I wonder whether public indecency can be established even in such a case. I do not recall being seen by anyone, so I would like to know whether it is still a problem and whether the situation changes if there is CCTV or a dashcam.

Hello. This is a sex crimes attorney at Daeryun Law LLC.

The question of whether public indecency can become an issue, even for an act done in the belief that one was alone, comes up very often during actual investigations.

Many people say, "No one was there" or "It was a space of my own," but the standard the law applies works differently than one might think.

The most important element in public indecency is not whether one was alone but whether the state was one that an unspecified number of people could perceive, that is, whether there was openness to the public.

In other words, the criterion for judgment is not who actually saw it but whether the environment was one in which it could be seen.

For example, even inside a vehicle, if the interior could be seen from the outside through the windows, there is room to recognize openness to the public.

An indoor space, likewise, may lead to the same judgment if the curtains were open or an outside line of sight was available.

In addition, these days footage from CCTV, dashcams, and nearby buildings is often used as evidence, so based solely on the statement "I thought there would be no one there," it is difficult to conclusively deny that a public indecency charge is established.

Investigative agencies comprehensively examine the openness of the location, the time of day, whether a line of sight was available, and the degree of the conduct in order to judge intent and openness to the public.

In particular, if you express things vaguely or make speculative remarks during the statement process, there is also a risk of being interpreted differently from what you intended.

Therefore, in public indecency cases, what matters is not whether you were alone but how the environment and conduct at the time are legally evaluated.

In this process, a sex crimes attorney can organize the issues so that no disadvantageous statements are made during the investigation stage and can specifically coordinate a direction for statements suited to the situation.

If you are facing an investigation for public indecency, organizing your response through a consultation with a sex crimes attorney can be helpful.
