Q
I have received a military salary reduction. Is an appeal also possible?
Views4,128
Hello. I am serving as a career soldier. Recently, while performing my duties, I used abusive language in the course of admonishing a soldier, and that became an issue, resulting in a one-month salary reduction measure being imposed within the unit. Although abusive language was mixed in, the content was work-related and intended to instill vigilance… I did not expect it to become such a serious issue. I am at fault to some degree, but since it was in the course of performing my duties, I felt that a military salary reduction was excessive. A one-month salary reduction does not cause great financial loss, but I feel it may create disadvantages for matters such as promotion in ways I may not even notice. Since I will be busy for a while, I am leaving a written inquiry before coming in person for a consultation.

Hello, this is an attorney specializing in military law.
It appears that you have received a salary reduction, which is one of the disciplinary actions that may be imposed on a soldier, namely dismissal, removal, demotion, suspension, salary reduction, confinement, and reprimand.
A military salary reduction is a disciplinary measure that reduces pay for a certain period within the limit of one-third of the remuneration, and it typically applies where the degree of misconduct is serious but the intent is not great, or where the degree of misconduct is minor but the degree of negligence is serious.
If the military salary reduction is judged to be unfair or unlawful in light of the circumstances, the person subject to discipline may file an appeal.
A military appeal must be filed within 30 days of the date of the disciplinary action, with the head of the unit or agency superior to the original disciplinary authority.
A mere assertion of unfairness is unlikely to be accepted, and it is important to legally substantiate and argue that the disciplinary action is excessive in violation of the principle of proportionality or the principle of equality.
For example, it is also necessary to specifically demonstrate matters such as whether there were extenuating circumstances in how you came to use abusive language toward the soldier, the urgency of the work instruction, and your deep remorse since the incident, and to submit supporting materials.
An appeal against a military salary reduction is a procedure in which the facts and legal principles must be systematically organized and persuasively argued, so it appears helpful to proceed with professional legal assistance.
Above all, a prompt response appears necessary in order to file the appeal within the deadline.
