I'd like to know how to calculate traffic accident damages. My fault is relatively large, but the damages and consolation money the other party is demanding are too high. The damage doesn't seem significant, yet they're asking for over 10 million won, which makes me feel wronged. In this case, is there a way to reasonably reduce the damages? To avoid criminal punishment, is settlement the only answer?

Assault offense refers to 'any unlawful exercise of physical force against the body' and does not necessarily have to result in injury (actual harm).
That is, the act of exercising physical force on the other party to contact or affect their body itself constitutes assault. For example, even forcefully pulling someone's hand can be recognized as assault.
If your hand was actually red and swollen, it can be considered that physical force was exercised on the body, so the assault offense is likely to apply.
Also, assault offense includes not only beating but also all exercises of physical force such as forcibly pushing or pulling, and depending on the case, blowing cigarette smoke or forcibly kissing may also constitute assault.
According to Article 260 of the Criminal Act, assault offense can be punished with imprisonment of up to 2 years or a fine of up to 5 million won, detention, or minor fine.
