Hello. This is a customs attorney.
Article 234 of Korea's Customs Act prohibits the import and export of certain goods in order to protect public safety and public order.
For example, in addition to books, videos, and sculptures that disturb the constitutional order or harm public morals, goods that may be used to leak government secrets or for espionage activities are also prohibited from import.
Counterfeits of forged or altered currency, bonds, and securities are also included among the prohibited items.
The problem here is that it is often difficult to determine whether the goods to be imported are clearly prohibited items.
Even if there appears to be no problem on the surface, goods may become subject to prohibition depending on their detailed use or composition, and the outcome may also vary depending on the interpretation of statutes such as the Customs Act or the administrative guidelines of customs.
Accordingly, cases sometimes arise in which confusion occurs at the actual customs clearance stage, or a party suffers a loss because the goods cannot be brought in.
